In “Litigants Seeking Information Sharing Need Better Protections,” Kevin and his co-authors examine the growing push—particularly in mass tort, antitrust, and data privacy cases—for litigants to share confidential discovery materials across related matters. While proponents argue this improves efficiency and reduces duplicative discovery, courts remain divided on whether and how to permit such sharing.
The article concludes that courts should take a more structured and cautious approach—allowing sharing only when clearly justified, narrowly tailored, and supported by strong procedural protections. Even then, existing discovery mechanisms already allow parties in other cases to request relevant information through proper channels, without weakening confidentiality safeguards.
